Important information about deadlines
When you receive a letter from us asking you to correct a deficiency or clarify something that is unclear, we set a deadline for when we must have received your reply.
The deadline may vary. It depends on what we are asking for and the stage the application has reached in the processing procedure.
It is important that you comply with our deadlines. This applies both when you need to reply to letters and when you need to pay fees and charges.
What happens if you do not meet the deadline?
If you do not meet the deadline, the application will be shelved, or you will lose the right to the patent, design or trademark.
Request an extension of time if you are unable to reply to the letter in time
If you see that you will not be able to reply to our letter containing an assessment of your application within the deadline we have set, you may request an extension of time. You must do this before the original deadline expires.
You may request an extension of time for trademark applications and design applications in the following ways:
- Self-service in “My Cases”
You can extend the deadline yourself if you need more time. The deadline is updated immediately, and you will receive a letter confirming the change.
- Form in Altinn or written request
You may also use the form for correspondence to the Norwegian Industrial Property Office in Altinn. Alternatively, you can send us an email or a letter. Remember to mark your request with “extension of time”.
Extensions of time for patent applications are granted automatically
You are granted an automatic two-month extension without receiving a separate reply from us. You must therefore keep track of the new deadline yourself.
You may receive an automatic extension of time twice for one application. If we are unable to grant an extension, we will notify you.
In wholly exceptional cases, extensions may be granted where there are special grounds.
Please note that the possibility of an extension of time does not apply to letters in which we ask you to correct formal deficiencies upon filing.
Pay before the extended deadline expires
For several types of fees and charges, even if you did not pay by the ordinary due date, you may still pay within an extended deadline. In some cases, you must also pay an additional fee.
What if you have already lost the application or the right?
You may request continued processing even if you failed to meet the deadline, provided that the failure to meet the deadline was unintentional.
You must do two things:
- carry out the action you failed to do within the deadline
- submit a written request for continued processing
