6. Application process

  1. 0 month

    Fill out the application and send it to us

    The application must contain:

    • Trademark and related products
    • Name of owner of the trademark
    • Power of attorney (if you apply on behalf of others)

  2. 0-3 days

    Your application will be made public

    Your application and all documents related to it will be published on our website in the Trademark Register. You can ask us to exempt business secrets from public disclosure. Highlight clearly the information in the application or attachments which you wish to be exempt. We will then assess whether the information can be exempted from public disclosure.

  3. 0-3 weeks

    We register the trademark, or contact you if the application contains deficiencies or obstacles to registration

    The application is assessed and examined. If the trademark can be registered, you will receive a letter of registration, and we will publish the registration in the Norwegian Trademarks Gazette. Dispatch of registration certificates may take some time. If you have not heard from us within 3 weeks, you can check the status of your application in our Search Service. You can also set up an alert to follow your case. If the application fails to meet the requirements of the Trademarks Act, we will contact you - either by calling or sending a letter. You will receive a 1-3-month deadline for responding to the letter.

  4. 3 months after publishing

    If the application is registered:

    Any objections from third parties

    If someone opposes the registration of your trademark, they may submit a complaint within 3 months from the date of publishing in the Norwegian Trademarks Gazette. This means that the Norwegian Industrial Property Office (NIPO) has been made aware of reasons why your trademark can not be registered. If this happens, you will be notified and able to respond to the objection. The objection may result in the registration being completely or partially cancelled.

  5. 0-3 months

    If you have received a letter form NIPO:

    You reply to our letter within the deadline

    It is important to comply with the deadlines in the letters you receive from us. Please use the correspondence form in Altinn. If you do not respond to our letter within the deadline, we will refuse your application. Please contact us if you have any questions.

  6. 0-9 months

    New assessment of the application

    Once we have received a letter from you, we will assess the application again. If everything is in order, we will register the trademark and publish the registration in the Norwegian Trademarks Gazette. If the trademark still does not comply with the Trademark Act, we will send you a new letter concerning this. You can then comment again in the matter before the Norwegian Industrial Property Office makes a final decision. You can appeal the final decision to our appeal body, Norwegian Board of Appeal for Industrial Property Rights (kfir.no).

  7. 3 months after publishing

    If the application is registered:

  8. 0-6 months

    Do you wish to apply in other countries?

    If so, you should do so within 6 months from the date you filed the application, because you will then keep the same filing date (date of priority) as your Norwegian application.

  9. 5 years

    Use your trademark

    You must use the trademark for the products that are important to your business within 5 years from the date of registration.

    There is no obligation to use the trademark, but if someone can prove that you have not used it for all or any of the products you have registered it for, you may lose your exclusive right in whole or in part.

  10. 10 years

    Renewal

    The trademark can be renewed every 10 years. You must pay a renewal fee for the trademark to continue to be registered in the Trademark Register.
