Harmonisation of practice in the EU

NIPO actively participates in harmonisation projects organised by the EUIPO and the national registration authorities in the EU. The aim is to ensure the most consistent possible practice for trademark registration within the EEA.

Below you will find an overview of harmonisation projects in the field of trademarks in which NIPO has participated, and which we consider to be in line with our practice:

The harmonisation is limited to the assessment of figurative marks where the textual element is considered directly descriptive or lacks distinctiveness. When can such marks, as a whole, be regarded as distinctive due to their figurative elements?

The project has resulted in a common practice on comparison of goods and services. Specifically on the topic of the treatment of terms lacking clarity and precision, and the interpretation of the Canon criteria and other relevant factors.

Representation before EUIPO

Norwegian representatives may represent their clients in trademark cases at all stages of the application process and in appeal proceedings before the EUIPO.

Norwegian Trademark Gazette

The Norwegian Trademark Gazette is an official publication that announces national and international trademarks that are valid in Norway. It contains information about registrations, renewals, amendments, transfers, oppositions, and reviews related to trademarks.

How do you find changes in representation?

Check the Trademark Gazette on a weekly basis. Use the filter Previous agent under Changes in party to find cases that are no longer associated with your agent’s office. Update the information in your own system as needed.
