How much does a trademark application cost?

How much you need to pay to apply for a trademark depends on the products you want to sell and where you want to protect the brand. Here you’ll find an overview of the costs you should expect when applying for trademark protection in Norway and internationally.

What determines the costs?

To get an overview of what expenses you need to budget for in a trademark process, you should start by thinking about the following:

Before you apply for trademark protection, you must have decided which goods or services your trademark will apply to.

Goods and services are divided into an international classification system with 45 classes. Classes 1-34 apply to goods, while classes 35-45 are for services.

How many classes you choose to tick helps determine how much a trademark application will cost.

A trademark registration is only valid in the country where you have applied for protection.

If you want to sell or produce in countries outside Norway, it is therefore important to register your trademark there as well.

In each country you must pay government fees and charges when you apply. The fees and the amount of these vary from country to country.

Some countries also require you to use a professional representative with a residential address in that country. Costs are in addition to the government fees.

You can either apply for protection in each individual country that is relevant to you, or use an international application system.

Which strategy is best and most cost-effective depends on which and how many countries are important to you.

  1. If you are going to use your trademark in many EU countries, it may be appropriate to apply for an EU trademark . This will give you protection in all member states with a single application.
  2. If you are going to use your trademark in several countries, including outside the EU, the international search procedure through the Madrid System may be right for you. You then choose the countries in which you want protection.
  3. If you only intend to invest in a few individual countries, it may be most practical to apply directly in these countries.

Applying for trademark protection in Norway can be relatively uncomplicated and easy to do on your own.

If you want to apply abroad, it can quickly become a little more complicated. There are also some countries that require you to have a professional representative with a residential address in the country to handle the case.

Using private legal advice from a professional advisor (often called an IP advisor) can therefore be a good investment. IP advisors know the different markets and the local rules. They can also help check whether the trademark can be used in the country in question, or whether you may encounter language or cultural barriers.

  • Start by applying in Norway, then apply with priority to the United States Patent and Trademark Office (USPTO) for trademark protection in the United States and the China National Intellectual Property Administration (CNIPA) for trademark protection in China.

When you want to apply for trademark protection in several countries, including outside the EU, we recommend using the Madrid system . It is easier and cheaper than applying in each individual country, as you only need to deal with one authority - the World Intellectual Property Organization (WIPO).

Why apply in Norway first?

Advantages of starting your trademark application in Norway before expanding to other countries:

  • You will receive an assessment of whether the trademark can be approved in Norway before investing time and money in international applications.
  • If you apply in other countries within six months of the Norwegian application, you can claim priority. This means that your trademark will have the same application date abroad as it does in Norway, which can provide stronger legal protection.

Trademark renewal fees in Norway

You can renew your trademark every 10 years an unlimited number of times.

  • Renewal fee (including one class): NOK 3 400
  • Additional fee per extra class: NOK 1 300

We do not send an invoice for renewal, but you will receive a notification letter from us 6 months before the payment deadline with information about what and how to pay.

Other fees and charges

  • Application for change in a registered trademark: NOK 1 200
  • Opposition to another party’s registered trademark: free
  • Request for administrative review of a trademark: NOK 4 000
  • Third-party request for cancellation of a trademark with an unknown owner: NOK 1 900
  • Division of a national application or an international trademark registration* under examination, for one class and an additional fee for each class beyond one: NOK 3 800 / NOK 1 000
  • Division of a national registration or an international trademark registration* that has taken effect in Norway: NOK 2 200
  • Merging of previously divided national applications, national registrations, or international trademark registrations: NOK 2 200
  • Reinstatement of application processing: NOK 550
  • Notification of transfer/merger: free of charge
  • Notification of name/address change: free
  • Request for continued processing despite deadline lapse: NOK 2 750

* When dividing international trademark registrations, a fee must also be paid to WIPO.

  • Renewal fee for up to one class: NOK 5 150
  • Additional fee for renewal of each class beyond one: NOK 2 100
  • Additional fee if renewal request is submitted after the registration period has expired: NOK 1 200
